Terms of Service

1. Who we are and what these Terms cover

MakerStudio ("MakerStudio", "we", "us", "our") is a browser-based 2D design and digital-fabrication platform for education, operated by Fablab Factory BV, a company incorporated in Belgium, with registered office at Capucienenlaan 88, 9300 Aalst, Belgium, company and VAT number BE 0700.541.423.

These Terms of Service ("Terms") form a binding agreement between you and us covering your access to and use of the MakerStudio websites, the MakerStudio web application, and any related services, content and software that link to these Terms (together, the "Service").

Our Privacy and Security Statement explains how we handle personal data and forms part of these Terms.

If you access the Service through an account provided by a school, Fab Lab, makerspace or other organisation (an "Institution"), the Institution's own agreement with us (its Order Form and, where applicable, the Data Processing Agreement) also applies, and prevails over these Terms where they conflict.

2. Who may use the Service

a. Adults. You may create your own MakerStudio account if you are 18 or older and are acting as an educator, staff member or representative of an educational organisation, or otherwise in a professional or personal capacity permitted by these Terms.

b. The free Design Trial is for adults only. Registration for the public Design Trial (section 4) requires confirmation that you are at least 18 years old and are registering as an educator, staff member or representative of an educational organisation. Do not register learners for a Design Trial account.

c. Learners (K1–12). MakerStudio is designed to be used by learners across the full school range, from K1 (around five years old) through grade 12. Learners access the Service only through an Institution that holds an institutional subscription, using an account created for them by that Institution (section 3). Learners never register themselves, whatever their age, and no learner account can be created from the public signup form.

d. Minimum age for a self-created account. No one below the age of digital consent in their country (13 in Belgium; between 13 and 16 across the EEA) may hold a self-created account. In practice, all self-created accounts are 18+ under (a) and (b), and all learner access runs through an Institution under (c).

e. If you don't meet these requirements, you are not authorised to access or use the Service.

3. Account types

a. You are responsible for your account. Keep your password confidential. Do not share, transfer or sell your account. Tell us at hello@makerstud.io immediately if you believe your account has been used without your authorisation.

b. Institutions are responsible for the accounts they create. An Institution that creates Coach, Learner or Avatar accounts is responsible for having a lawful basis to do so, for informing learners and (where required) their parents or guardians, and for the use those accounts make of the Service. c. One account per person. Registering the same person twice, or registering under someone else's identity, is not permitted. Our signup flow prevents duplicate trial accounts for the same email address.

4. The free Design Trial

This section applies to the public MakerStudio Design Trial offered from the soft launch on 29 July 2026.

a. What you get. Six weeks (42 days) of free access to the browser-based design environment: simplified educational interface, Chromium/Chromebook support, preset shapes and the shape generator, text and font tools, image and SVG import, image tracing, automatic nesting, cloud storage, and SVG export. No credit card is required.

b. What is not included. The trial covers the Design pillar only. It does not include managing learner or avatar accounts, creating classroom activities, machine management, material management, recommended fabrication parameters, or the direct generation of proprietary machine-code formats. Those are institutional-subscription features (section 5).

c. When it starts. The 42 days begin at email verification, not at registration.

d. Extension by referral. The trial can be extended by 14 days per qualifying referral, to a maximum of two extensions (10 weeks in total). A referral qualifies when the person you invited verifies their own trial and completes their first SVG export. We may change or withdraw the referral programme at any time for future referrals; extensions already granted are not withdrawn.

e. What happens at expiry. On expiry your account locks: you can no longer sign in to design or export. Export your designs as SVG before your trial ends.

f. Retention after expiry. We retain your trial account and files for 90 days after expiry and then delete them permanently. We will email you before that deletion. During the trial you can delete individual designs yourself; to delete your whole account and data at any time, write to privacy@makerstud.io.

g. Soft-launch status. The trial is a preview. Features may change, be added or be removed, and availability is on a reasonable-efforts basis without an uptime commitment (section 14).

5. Institutional subscriptions

a. Ordering. Institutional access is provided under an Order Form agreed between us and the Institution, which sets out the subscription scope (institute base, administrator, coach, learner and avatar accounts), the term, the fees and the billing arrangements.

b. Fees and payment. Fees are stated exclusive of VAT and other applicable taxes unless the Order Form says otherwise. Payment terms are set out in the Order Form.

c. Term and renewal. The subscription runs for the term set out in the Order Form and renews only by agreement between us and the Institution — there is no automatic renewal. We will contact the Institution in good time before the term ends so it can decide whether to continue.

d. Institutional features. Depending on the subscription, institutional accounts may include fabrication workflows (laser cutting, vinyl cutting, plotting, embroidery), machine-specific output, machine and material management, recommended fabrication settings, activities and teams, and the institutional dashboard.

e. Suspension for non-payment. We may suspend an Institution's access after written notice and a reasonable opportunity to pay. We will not delete Institution content solely because of a payment dispute without first giving the Institution a reasonable opportunity to export it.

6. Changes to the Service and to these Terms

a. The Service. We may add, change, or discontinue features. Where a change materially reduces functionality that an Institution is paying for, we will give the Institution reasonable advance notice.

b. These Terms. We may update these Terms — for example to reflect new features, or to comply with law. We will publish the updated version with a new "Last updated" date and, for material changes, notify you by email at least 30 days before they take effect.

c. If you disagree. If you do not accept a material change, you may terminate your account before the change takes effect by writing to hello@makerstud.io. For paid subscriptions, we will refund the pro-rata portion of any fees paid for the unused remainder of the term. Continuing to use the Service after the change takes effect means you accept the updated Terms.

7. Your content

a. You own your work. You keep all rights in the designs, files, images and other material you create or upload ("Your Content"). These Terms do not transfer any ownership in Your Content to us, and we do not claim any.

b. The limited licence you give us. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, render, display, back up, reformat and export Your Content solely to the extent necessary to operate, secure, support and improve the Service for you and for the users you share it with. This licence exists only for as long as we hold Your Content, and ends when you delete it or your account is deleted (subject to short backup-rotation and legal-retention periods described in our Privacy and Security Statement). c. No marketing use without your permission. We will not use Your Content in marketing, promotion, case studies, screenshots or public galleries unless you give us separate, specific, written permission. You can withdraw that permission at any time, and we will stop using the material in new materials and remove it from materials we control within a reasonable time.

d. No AI training. We do not use Your Content, learner work, or personal data to train, fine-tune or evaluate machine-learning or generative-AI models, and we do not permit our service providers to do so.

e. Sharing is your choice. Your Content is private to you by default. Where the Service lets you share a design — with a coach, a team, an Institution, or publicly — you control that, and you are responsible for what you choose to share. Within an institutional subscription, learner work is visible to the Institution's Administrators and to the Coaches responsible for that learner; it is not visible to other learners unless shared through an activity or team.

f. Your responsibility for Your Content. You confirm that you hold the rights needed to upload and use Your Content, and that it does not infringe anyone else's rights or break any law. Do not upload material you do not have the right to use — including copyrighted artwork, logos or characters.

g. A future public library. We may in future add a public library where users can choose to publish designs for others to use. Today no such library exists, and nothing in these Terms gives us the right to publish Your Content. If we launch one, publication will be opt-in for each individual design, the licence that attaches to a published design will be set out in terms published before the library opens, and you will be able to withdraw a design from it. We will not move existing designs into a public library.

h. Do not upload sensitive personal data. The Service is not designed to store special categories of personal data (health data, biometric data, data revealing racial or ethnic origin, political opinions, religious beliefs, trade-union membership, sex life or sexual orientation) or identification, financial or medical numbers. Do not put such data into designs, file names or account fields.

8. Acceptable use — our "be kind" policy

MakerStudio is used in classrooms with children. Do not create, upload, share or make available through the Service any content that:

• is threatening, abusive, harassing, hateful, defamatory, obscene, pornographic, or otherwise harmful or inappropriate in an educational setting;
• sexualises, endangers or exploits minors;
• breaks any applicable law, or would create legal liability for you, another user or us;
• infringes anyone's intellectual-property, privacy or publicity rights;
• discloses another person's personal data without a lawful basis;
• contains malware, or is designed to disrupt or damage software, hardware or equipment;
• promotes the manufacture of weapons or of objects intended to cause harm; or
• impersonates another person or organisation.

You must also not: attempt to access another user's account or content; probe, scan or test the security of the Service without our prior written permission; interfere with or overload the Service; scrape or bulk-download content; circumvent access, expiry or usage limits (including trial expiry); reverse-engineer, decompile or disassemble the Service except to the extent this cannot lawfully be prohibited; remove proprietary notices; or resell or provide the Service to third parties without our written agreement.

Reporting. Report content or behaviour that breaches this section to hello@makerstud.io. We review reports and may remove content, suspend accounts, or notify the relevant Institution.

9. Our intellectual property

The Service — including its software, interface, design, shape libraries, generated shapes, documentation, brand, name and logos — belongs to us and our licensors. These Terms grant you only a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with them and, where applicable, your Institution's Order Form. No rights are granted by implication. You may not use our name, logo or trademarks without our written permission.

Files you export (such as SVG) are Your Content and carry no licence restriction from us.

10. Feedback

If you send us ideas, suggestions or feedback about the Service, we may use them without obligation, restriction or payment. We will not identify you as the source without your permission. This does not give us any rights in Your Content (section 7).

11. Third-party content, services and machines

The Service may link to or interoperate with third-party websites, services, file formats and fabrication machines that we do not control. We are not responsible for them, and your use of them is governed by their own terms. Where the Service lets you import content from a third-party source, you are responsible for having the right to use that content.

12. Privacy and data protection

a. Our statement. How we collect and use personal data is set out in our Privacy and Security Statement.

b. Trial and self-created accounts. For Design Trial accounts and other self-created accounts, we are the data controller for the account data described in that statement.

c. Institutional accounts. Where an Institution creates Coach, Learner or Avatar accounts and uses the Service to manage them, the Institution is the data controller and we act as processor on its documented instructions. Our processing terms will be set out in a Data Processing Agreement (DPA), which is currently in preparation. Institutions can request its status, and a copy once it is available, from privacy@makerstud.io.

d. The Institution's own obligations. Each Institution is responsible for its own compliance: for having a lawful basis to process learner data, for informing learners and parents or guardians, for its retention and access policies, and for responding to data-subject requests from its learners. We will assist as required under Article 28 GDPR.

e. Avatar accounts. If an Institution does not want to process learner identities at all, it can use anonymous avatar accounts (section 3), which are designed so that no learner name or contact detail is stored in MakerStudio.

f. Hosting. The Service is hosted on infrastructure operated by OVHcloud in Frankfurt, Germany, within the European Union. See our Privacy and Security Statement for storage locations, service providers and retention periods.

g. Advertising

There is no advertising in the Service today. Should we introduce any, the following are permanent commitments and are not subject to change:

• No advertising will ever be shown to a Learner account, an Avatar account, or any account belonging to a person under 18.
• Learner data will never be used to target, select or measure advertising, including advertising shown to an adult.
• We will never use an advertising network, tracking pixel, behavioural targeting or profiling, and we will never sell or share personal data with an advertiser.

Any advertising we do introduce will be limited to adults on free or trial accounts, will not appear inside a paid institutional subscription, will not appear on the design canvas or in any full-screen or presentation view, and will be announced at least 30 days in advance under section 6b. 13. Storage, backups and exporting your work

We apply reasonable measures to store and back up content, but you are responsible for keeping your own copies. Export your designs regularly, and always before a trial expires (section 4e) or a subscription ends. We may set storage limits, and may archive or restrict accounts that have been inactive for an extended period, after notifying you by email.

14. Availability

The Service is provided on a reasonable-efforts basis. During the soft-launch period there is no uptime commitment or service-level agreement. We may carry out maintenance, and will try to schedule planned maintenance outside European school hours and to announce it in advance.

15. Fabrication and physical safety — please read

MakerStudio produces design files. It does not operate machines for you, and it cannot see your workshop.

• You are responsible for safe machine operation. Always follow the manufacturer's instructions, your machine's safety requirements, and your Institution's safety rules and supervision policies. Laser cutters, vinyl cutters, plotters and embroidery machines can cause fire, burns, cuts, eye injury and harmful fumes.
• Recommended fabrication parameters are suggestions only. Where the Service suggests settings for a machine or material, they are starting points based on general information — not a guarantee. Verify them for your specific machine, material and conditions, and test on scrap first.
• Materials. You are responsible for confirming that a material is safe to process with your machine and process. Some materials release toxic fumes when cut or engraved (PVC is one well-known example). We do not warrant the suitability, safety or legality of any material.
• Outputs are not certified. Objects designed with the Service are not tested or certified for safety, load-bearing use, food contact, medical use, or use as children's toys, unless you carry out that testing and certification yourself.
• Supervision of learners. Institutions and their staff remain responsible for supervising learners around fabrication equipment.

16. Warranties and disclaimers

Except as expressly stated in these Terms or an Order Form, and to the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", and we exclude all implied warranties and conditions, including fitness for a particular purpose, merchantability and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure against every threat, or that it will produce any particular result.

The Service is a design tool, not a substitute for your own professional judgement, testing or verification.

Nothing in these Terms excludes or limits your mandatory statutory rights. If you are a consumer, you keep all rights you have under Belgian and EU consumer law, including the statutory conformity guarantee, and this section applies only so far as the law allows.

17. Liability

a. What we never exclude. Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; wilful misconduct or gross negligence ("opzet of zware fout"); or any other liability that cannot lawfully be excluded or limited.

b. Excluded losses. Subject to (a), we are not liable for indirect or consequential loss, loss of profits, loss of revenue, loss of anticipated savings, business interruption, loss of goodwill, or loss or corruption of data, in each case to the extent permitted by law.

c. Your work. You are responsible for keeping copies of Your Content (section 13). Subject to (a), we are not liable for loss of Your Content where you have not kept your own copies.

18. Indemnity (organisations only)

If you use the Service on behalf of an organisation, that organisation will indemnify us against third-party claims, and reasonable legal costs, arising from: (i) content it or its users upload in breach of section 7 or section 8; (ii) its breach of these Terms; (iii) its failure to obtain a lawful basis or the consents it needs for learner data; or (iv) unsafe operation of fabrication equipment. We will notify the organisation promptly of any such claim and will not settle it without the organisation's consent, not to be unreasonably withheld.

This section does not apply to consumers.

19. Suspension and termination

a. You may stop at any time. Delete your designs, stop using the Service, or ask us to delete your account at hello@makerstud.io.

b. We may suspend or terminate your access if you materially breach these Terms, if your use puts the Service, other users or learners at risk, or if we are required to do so by law. Except where the breach is serious or urgent, or where the law requires immediate action, we will give you notice and a reasonable opportunity to put things right first.

c. Effect. On termination your right to use the Service ends. Where circumstances reasonably allow, we will give you an opportunity to export Your Content before it is deleted, and we will tell you how long you have to do so. Your Content is then deleted in line with the retention periods in our Privacy and Security Statement. Trial accounts follow the timetable in section 4f.

d. Survival. Sections 7 (as to ownership), 9, 15, 16, 17, 18, 20 and 21 survive termination.

20. Governing law, complaints and disputes

a. Governing law. These Terms are governed by Belgian law, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.

b. Courts. The courts competent for our registered office in Aalst, in the judicial arrondissement of East Flanders, Belgium, have exclusive jurisdiction — except that if you are a consumer, you may also bring proceedings in the courts of your own country of residence, and mandatory consumer-protection rules of that country continue to apply to you.

c. Talk to us first. Please contact hello@makerstud.io before starting proceedings; most issues are faster to resolve directly.

d. Consumers. If you are a consumer in Belgium and we cannot resolve a complaint, you can contact the Belgian Consumer Mediation Service (Consumentenombudsdienst / Service de Médiation pour le Consommateur), North Gate II, Koning Albert II-laan 8 bus 1, 1000 Brussels.

e. Data-protection complaints go to the Belgian Data Protection Authority — see our Privacy and Security Statement.

21. General

• Entire agreement. These Terms, our Privacy and Security Statement, and any Order Form and DPA, are the whole agreement between us about the Service.
• Order of precedence. Order Form → DPA → these Terms → other published policies.
• Severability. If a provision is held unenforceable, the rest stays in force and the provision is applied as far as the law allows.
• No waiver. Not enforcing a right at one time does not waive it.
• Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, reorganisation or sale of the business, provided your rights are not reduced.
• No partnership. These Terms do not create a partnership, agency or employment relationship.
• Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
• Language. The English version of these Terms is the governing version. Translations are provided for convenience.
• Notices. We will contact you at the email address on your account. Contact us at hello@makerstud.io, or privacy@makerstud.io for data-protection matters.

• Institution — a school, Fab Lab, makerspace or other organisation holding an institutional subscription.
• Administrator / Coach / Learner / Avatar account — as described in section 3.
• Design Trial — the free 42-day offer described in section 4.
• Order Form — the ordering document agreed between us and an Institution.
• Service — as defined in section 1.
• Your Content — as defined in section 7.
